17. EXPRESS PRODUCT REPRESENTATIONS
Product-specific representations made by SIEB are those expressly contained in authorized Product listings, Product labels, packaging, written warranties or other authorized SIEB communications.
Nothing in this Legal Notice eliminates any express representation or warranty that applicable law treats as binding.
18. NO UNAUTHORIZED THIRD-PARTY WARRANTIES
Unless expressly authorized by SIEB, independent:

Material composition may differ between Product categories, styles and production batches where legally permitted.

Where required by applicable law, applicable textile Products will bear required fiber-content information.
Customers should rely upon the actual Product label and Product-specific information for the composition of the particular Product received.

Reasonable differences may occur in:

A Product may be manufactured in one country and shipped from another.

APPAREL & TEXTILE USE
34. PRODUCT CARE
Customers are responsible for following washing, drying, ironing, cleaning and other Product care instructions.
35. NORMAL WEAR AND TEAR
Depending upon Product type, materials, use and care, ordinary changes may include:
• Fading;
• Pilling;
• Stretching;
• Shrinking;
• Wrinkling;
• Surface wear;
• Print wear;
• Embroidery wear;
• Elasticity changes; or
• Other ordinary deterioration.
Normal wear and tear does not automatically constitute a manufacturing defect.
36. IMPROPER WASHING OR CLEANING
To the maximum extent permitted by applicable law, SIEB is not responsible for damage caused solely by:
• Washing contrary to instructions;
• Improper drying;
• Excessive heat;
• Bleach;
• Unsuitable chemicals;
• Improper detergents;
• Improper ironing;
• Dry cleaning contrary to instructions; or
• Other improper care.
37. CROSS-CONTAMINATION DURING WASHING
To the maximum extent permitted by law, SIEB is not responsible for dye transfer, staining, contamination or Product damage caused solely by washing Products with incompatible items, chemicals, detergents or materials contrary to reasonable care instructions.
HAIR ACCESSORIES
38. HAIR ACCESSORY USE
Hair ties, scrunchies, headbands, clips and other hair accessories should be used only for their intended purpose.
Customers should discontinue use where an accessory becomes materially broken, sharp, exposed or unsafe.
39. SMALL PARTS
Hair accessories and other Products may contain small components.
Small components may create choking, pinching, entanglement or other hazards if misused.
Keep potentially hazardous components away from infants and young children.
BAGS & CARRYING ACCESSORIES
40. BAG USE
Bags, totes, pouches and similar Products should be used only for their reasonably intended purposes.
Customers should not unreasonably overload a Product.
41. NO SPECIAL PROTECTIVE CHARACTERISTICS UNLESS STATED
Unless expressly stated for a specific Product, customers should not assume a bag or accessory is:
• Waterproof;
• Fireproof;
• Impact-resistant;
• Theft-resistant;
• Insulated;
• Chemical-resistant; or
• Designed to protect electronics, valuables or specialized equipment.
WATER BOTTLES & DRINKWARE
42. DRINKWARE USE
Water bottles, reusable beverage containers, tumblers and similar Products should be used according to their intended purposes and Product-specific instructions.
43. INSPECTION OF DRINKWARE
Customers should discontinue use of drinkware that becomes:
• Cracked;
• Broken;
• Materially deformed;
• Leaking in an unsafe manner;
• Contaminated; or
• Otherwise apparently unsafe.
44. TEMPERATURE AND CLEANING LIMITATIONS
Unless expressly stated for a specific Product, customers should not assume drinkware is:
• Microwave-safe;
• Dishwasher-safe;
• Freezer-safe;
• Suitable for boiling liquids;
• Suitable for hot beverages;
• Suitable for carbonated beverages; or
• Completely leakproof.
45. HOT LIQUIDS
Customers should not place boiling or hot liquids in drinkware unless the specific Product is expressly represented as suitable for such use.
Hot liquids may cause burns.
46. LIDS, CAPS AND STRAWS
Customers should properly secure lids, caps, straws and removable components before use.
SIEB does not guarantee that every beverage container will prevent every possible spill or leak under every circumstance.
TOWELS, BEACH & POOL ACCESSORIES
47. TOWELS
Unless expressly represented otherwise, towels and similar textile Products are ordinary consumer textile Products.
48. NO FLOTATION OR LIFE-SAVING FUNCTION
Unless expressly represented otherwise, towels, bags and other lifestyle Products are not:
• Flotation devices;
• Life-saving devices;
• Rescue equipment;
• Medical devices;
• Personal protective equipment; or
• Professional safety equipment.
ALLERGIES, SENSITIVITIES & REACTIONS
49. MATERIAL SENSITIVITIES
Individuals may react differently to:
• Fabrics;
• Fibers;
• Dyes;
• Finishes;
• Elastic;
• Plastics;
• Coatings;
• Adhesives;
• Packaging materials;
• Detergent residue; or

Customers with known sensitivities should review available Product information before use.
50. ALLERGIC OR SKIN REACTIONS
Customers should discontinue use and obtain appropriate medical attention where necessary if a Product appears to cause a significant allergic, skin or other adverse reaction.
The existence of a reaction alone does not establish its cause or legal responsibility.
51. NO MEDICAL REPRESENTATIONS
Unless expressly stated otherwise, SIEB Products are fashion and lifestyle Products.
They are not intended to diagnose, treat, cure, mitigate or prevent disease or medical conditions.
Nothing on the SIEB website constitutes medical advice.
PRODUCT INSPECTION & CUSTOMER SAFETY
52. INSPECTION BEFORE USE
Customers should reasonably inspect Products before use.
Do not use a Product that reasonably appears:
• Materially defective;
• Broken;
• Contaminated;
• Sharp;
• Leaking;
• Chemically affected;
• Tampered with;
• Unsafe; or
• Otherwise materially damaged.
53. CUSTOMER DUTY TO DISCONTINUE USE
Customers should discontinue use where:
• A Product becomes materially damaged;
• A material safety hazard becomes apparent;
• SIEB issues a stop-use instruction;
• A governmental authority issues a stop-use instruction; or
• A Product becomes subject to a recall applicable to the customer.
54. CONTINUED USE AFTER KNOWN HAZARD
To the maximum extent permitted by applicable law, SIEB is not responsible for additional harm caused solely by continued use after a customer knew or reasonably should have known that continued use presented a material danger.
PRODUCT MISUSE & MODIFICATION
55. MISUSE
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIEB IS NOT RESPONSIBLE FOR INJURY, DAMAGE, LOSS OR EXPENSE CAUSED SOLELY BY:
• Product misuse;
• Abuse;
• Reckless use;
• Improper handling;
• Improper storage;
• Improper washing;
• Improper cleaning;
• Failure to follow warnings;
• Failure to follow instructions;
• Use for an unintended purpose;
• Unauthorized alteration; or
• Other customer conduct for which SIEB is not legally responsible.
56. PRODUCT MODIFICATION
Cutting, sewing, altering, decorating, repairing, adding components, removing components or otherwise modifying a Product may affect performance and safety.
To the maximum extent permitted by law, SIEB is not responsible for harm caused solely by unauthorized post-sale modification.
57. THIRD-PARTY ALTERATIONS
To the maximum extent permitted by law, SIEB is not responsible for injury or damage caused solely by repairs, alterations, embroidery, printing, modifications or other work performed by an independent third party selected by the customer after purchase.
CONTAMINATION, INFECTION & HAZARDOUS CONDITIONS
58. CONTAMINATION
Products and packages may pass through independent manufacturers, warehouses, fulfillment facilities and shipping networks.
To the maximum extent permitted by applicable law, SIEB is not responsible for contamination caused solely by an independent third party or event outside SIEB's reasonable control.
59. BIOLOGICAL CONTAMINATION
If a Product or package reasonably appears contaminated by bacteria, viruses, fungi, mold, bodily fluids, biological materials or other potentially harmful substances, customers should discontinue use or handling as appropriate.
60. INFECTION AND DISEASE
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIEB SHALL NOT BE RESPONSIBLE FOR INFECTION, DISEASE, ILLNESS OR OTHER HARM CAUSED SOLELY BY BIOLOGICAL CONTAMINATION INTRODUCED BY AN INDEPENDENT THIRD PARTY OR EVENT OUTSIDE SIEB'S REASONABLE CONTROL.
Nothing in this provision eliminates any liability imposed directly upon SIEB by applicable law.
61. CHEMICAL EXPOSURE
Customers should discontinue use or handling where a Product or package reasonably appears affected by an unknown or hazardous chemical substance.
To the maximum extent permitted by law, SIEB is not responsible for chemical contamination caused solely by independent third parties or circumstances outside SIEB's reasonable control.
62. MOLD AND MILDEW
Customers should not use a Product reasonably appearing materially affected by mold, mildew, unusual moisture or another condition creating an apparent safety concern.
Responsibility will depend upon the circumstances and applicable law.
63. INFESTATION
Customers should avoid unnecessary handling where a Product or package reasonably appears to contain insects, pests or evidence of infestation.
To the maximum extent permitted by law, SIEB is not responsible for infestation caused solely by independent transportation, warehousing, delivery or environmental conditions outside SIEB's reasonable control.
INJURY, SERIOUS HARM & DEATH
64. PHYSICAL INJURY
If a customer believes a Product or package caused physical injury, the customer should discontinue use or handling as reasonably appropriate and seek appropriate medical attention when necessary.
65. ADVERSE EVENTS
Potential reported adverse events may include:
• Cuts;
• Burns;
• Skin injuries;
• Allergic reactions;
• Infection;
• Illness;
• Chemical exposure;
• Biological exposure;
• Contamination exposure;
• Choking;
• Entanglement;
• Property damage; or
• Other physical harm.
Customers should contact SIEB promptly concerning serious Product-safety concerns.
66. SERIOUS INJURY AND DEATH
If a Product or package is alleged to have caused or contributed to serious injury or death, SIEB may investigate, preserve information, communicate with manufacturers or suppliers, cooperate with governmental authorities and take other action required or permitted by applicable law.
NOTHING IN THIS LEGAL NOTICE EXCLUDES OR LIMITS LIABILITY FOR DEATH, PERSONAL INJURY OR OTHER HARM WHERE APPLICABLE LAW PROHIBITS SUCH LIABILITY FROM BEING EXCLUDED OR LIMITED.
67. PRESERVATION OF EVIDENCE
Where reasonably safe, customers reporting a serious injury, contamination, safety or Product-defect claim should retain:
• The Product;
• Product labels;
• Product packaging;
• Shipping packaging;
• Shipping labels;
• Photographs;
• Order information; and
• Other potentially relevant evidence.
PRODUCT SAFETY & RECALLS
68. PRODUCT SAFETY
SIEB intends to address Product-safety concerns in accordance with applicable law.
No disclaimer contained in this Legal Notice authorizes SIEB to disregard a mandatory Product-safety obligation.

Reasonable packaging variation does not automatically constitute a Product defect.
