PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING THIS WEBSITE, PLACING AN ORDER, PURCHASING A PRODUCT, OR USING ANY SIEB PRODUCT.
1. OVERVIEW AND ACCEPTANCE
This website and online store are operated by SIEB LLC (“SIEB,” “we,” “us,” “our,” or the “Company”).
These Terms of Service (“Terms”) govern your access to and use of the SIEB website, Shopify store, authorized sales channels, Products, Services, content, communications, transactions and related features.
“You,” “your,” “Customer,” and “user” mean any person accessing the Services or purchasing Products.
By accessing or using the Services, creating an account, submitting an order, purchasing a Product, or otherwise transacting with SIEB, you acknowledge that you have read, understood and agree to these Terms and the policies incorporated by reference.
If you do not agree, do not use the Services or purchase Products.
Nothing in these Terms waives, excludes, restricts or limits any right, warranty, remedy, duty or liability that applicable federal, state or local law prohibits from being waived, excluded, restricted or limited.
PRODUCTS AND PRODUCT REPRESENTATIONS
2. PRODUCTS COVERED
“Products” includes all merchandise currently or subsequently offered by SIEB, including without limitation:
• Clothing and apparel;
• Activewear, leisurewear and loungewear;
• T-shirts, tops, sweatshirts and hoodies;
• Shorts, leggings, pants, skirts and dresses;
• Socks;
• Hats, caps and headwear;
• Bags, totes, pouches and carrying accessories;
• Hair ties, scrunchies, headbands, clips and other hair accessories;
• Towels, beach towels and textile accessories;
• Water bottles, reusable beverage containers, tumblers and drinkware;
• Pool and beach accessories;
• Fitness accessories;
• Fashion, lifestyle and travel accessories;
• Seasonal and promotional merchandise;
• Bundles and gift items; and
• Other related consumer merchandise offered by SIEB now or in the future.
These Terms apply to all Products unless separate Product-specific terms expressly apply.
3. PRODUCT INFORMATION
SIEB makes reasonable efforts to provide accurate Product descriptions, specifications, measurements, materials, colors, availability and other information.
Information may nevertheless be subject to reasonable manufacturing variations, supplier changes, production changes, technical limitations or inadvertent errors.
SIEB may correct or update Product information where appropriate and permitted by law.
4. VISUAL CONTENT
SIEB may use Product photography, studio photography, lifestyle photography, model photography, videos, advertisements, social-media imagery, collection imagery, illustrations, drawings, graphics, digital renderings, computer-generated imagery, Product mockups, manufacturer or supplier mockups, AI-generated imagery, AI-assisted imagery, digitally enhanced imagery, retouched photographs, composite images, background replacements, visual effects and other visual representations (“Visual Content”).
Visual Content may be used for illustrative, promotional, artistic, styling, demonstration or marketing purposes.
Physical Products may reasonably differ from Visual Content in certain respects.
5. AI-GENERATED, AI-ASSISTED AND DIGITAL CONTENT
SIEB may use artificial intelligence, digital rendering, computer-generated imagery or similar technologies in creating, modifying or enhancing Visual Content.
Such content may contain simulated or illustrative models, environments, backgrounds, lighting, styling, proportions, accessories or Product presentations.
AI-generated, AI-assisted, digitally rendered or simulated imagery does not guarantee that every visual characteristic will be reproduced identically in the physical Product.
Customers should review the applicable Product title, written description, specifications, measurements, sizing information and expressly identified purchase contents.
6. VISUAL EFFECTS AND PERCEIVED APPEARANCE
Camera angles, lenses, perspective, lighting, shadows, reflections, cropping, magnification, model positioning, image enhancement, editing, digital effects and background composition can affect perceived Product size, shape, depth, scale, proportion, color, brightness, texture, fit and appearance.
Visual presentation does not guarantee that a physical Product will appear precisely identical under every viewing condition.
7. PRODUCT MOCKUPS
Mockups are illustrative representations and may not reproduce every physical characteristic with absolute precision.
Reasonable production differences may occur in print dimensions, logo dimensions, logo placement, graphic positioning, embroidery, stitching, seams, pattern alignment, colors and similar characteristics.
8. COLORS
Electronic displays cannot guarantee precise reproduction of physical colors.
Colors may vary because of device type, display technology, screen calibration, brightness, browser settings, photography, lighting, image processing, compression, materials, dye lots and production batches.
Reasonable color differences do not automatically constitute Product defects.
9. MATERIALS AND TEXTURES
Digital imagery cannot precisely reproduce tactile characteristics.
Fabric, texture, softness, thickness, finish and other physical characteristics may look or feel different in person.
Customers should review available written material information.
10. SIZE, SCALE AND PROPORTION
Photographs may not represent exact scale or dimensions.
Camera angles, perspective, lens choice, cropping, model dimensions and positioning can affect perceived proportions.
Customers should rely upon written measurements and sizing information rather than determining exact dimensions solely from photographs.
11. MODELS AND FIT
Models and mannequins are illustrative.
A Product's appearance on a model does not guarantee identical fit or appearance on another person.
Height, weight, body proportions, body shape, styling and personal preference may affect fit and appearance.
12. BACKGROUNDS, PROPS AND OTHER ITEMS
Visual Content may contain clothing, footwear, accessories, bottles, bags, towels, furniture, decorations, food, beverages, equipment, vehicles, buildings, scenery and other objects used for styling, atmosphere, scale, demonstration or presentation.
Backgrounds and environments may be real, staged, edited, digitally altered, simulated or AI-generated.
ONLY PRODUCTS EXPRESSLY IDENTIFIED IN THE APPLICABLE PRODUCT LISTING AS INCLUDED IN THE PURCHASE ARE INCLUDED IN THE CUSTOMER'S ORDER.
An item's appearance in Visual Content does not mean that item is included.
13. PACKAGING
Packaging, labels, inserts and shipping presentation may differ from photographs or change over time.
Packaging shown in Visual Content is illustrative unless expressly stated otherwise.
Reasonable packaging variations do not automatically constitute Product defects.
14. PHOTOGRAPHIC, LISTING AND TECHNICAL ERRORS
Despite reasonable efforts to maintain accurate listings, inadvertent errors may occur, including incorrect, outdated, mismatched or duplicate photographs; incorrect colors, descriptions, specifications, dimensions, inventory, availability, prices or promotional information; and other website or technical errors.
SIEB may correct inadvertent errors when discovered and take appropriate action regarding affected orders to the extent permitted by law.
Nothing in these Terms permits intentional deception, fraud or material misrepresentation.
MANUFACTURING, SOURCING AND ORIGIN
15. MANUFACTURING AND PRODUCTION
Products may be designed, sourced, manufactured, produced, printed, embroidered, finished, assembled, packaged, stored, fulfilled or shipped by SIEB and/or independent manufacturers, suppliers, vendors, printers, fulfillment providers, warehouses and logistics providers located within or outside the United States.
Different Products, styles, colors, sizes, components or production batches may originate from different facilities or countries.
16. COUNTRY OF ORIGIN
Products, fabrics, raw materials, components, accessories and packaging may originate from the United States or other countries.
A Product may contain materials or components originating in countries different from the location where the finished Product was assembled, manufactured, printed, embroidered, finished, packaged or shipped.
SIEB will provide country-of-origin information where required by applicable law.
17. SHIPPING ORIGIN IS NOT MANUFACTURING ORIGIN
The location from which an order ships does not necessarily identify where the Product was manufactured.
A Product may be manufactured in one location and transported elsewhere for printing, embroidery, finishing, storage, inspection, packaging or fulfillment.
Warehouse locations, fulfillment addresses, carrier scans, shipping labels and return addresses should not be interpreted as Product-origin representations unless expressly identified as such.
18. MATERIAL AND COMPONENT SOURCING
Products may incorporate fabrics, fibers, threads, dyes, plastics, elastics, closures, labels, packaging, bottle components, caps, straws, hardware and other components from multiple suppliers and geographic locations.
Sources may change between production batches where legally permitted.
Reasonable sourcing changes that do not materially alter advertised characteristics, safety or legal conformity do not automatically constitute defects.
19. SUPPLIER AND MANUFACTURER CHANGES
To the extent permitted by law, SIEB may change manufacturers, suppliers, production facilities, fulfillment partners, materials or sourcing arrangements without individual customer notice, provided Products remain materially consistent with their descriptions and legally required disclosures remain accurate.
20. THIRD-PARTY MANUFACTURERS
SIEB may use independent manufacturers, suppliers, printers, embroiderers and production vendors.
To the fullest extent permitted by applicable law, SIEB is not responsible for independent acts or omissions of such third parties outside SIEB's reasonable control.
Nothing eliminates responsibility imposed directly upon SIEB by applicable product-safety, labeling, warranty, consumer-protection, import or product-liability law.
21. PRINT-ON-DEMAND AND MADE-TO-ORDER PRODUCTS
Certain Products may be manufactured, printed, embroidered, finished, packaged or fulfilled after an order is placed.
Production and fulfillment locations may vary according to Product type, availability, destination, production capacity and provider operations.
22. IMPORTED PRODUCTS AND INTERNATIONAL SOURCING
Products or Product components may be imported into the United States.
Customs processing, inspection, transportation, international logistics, port conditions, border restrictions, government actions or other events may affect availability or fulfillment.
23. NO ASSUMPTION OF U.S. MANUFACTURE
The SIEB brand, SIEB LLC's U.S. organization, operation of a U.S.-based website, U.S. dollar pricing, or shipment to or from a U.S. address does not represent that a Product or all of its components were manufactured or sourced in the United States.
A Product should be considered “Made in USA,” “Made in the USA,” or of another specific national origin only where SIEB expressly makes that representation in accordance with applicable law.
ORDERS, PRICING AND PAYMENT
24. PRODUCT AVAILABILITY
All Products are subject to availability.
SIEB may modify, discontinue or limit Products, colors, sizes, styles or quantities.
Inventory information may occasionally be inaccurate because of simultaneous purchases, supplier changes or technical synchronization.
25. SIZING AND FIT
Sizing and fit may vary among Products, fabrics, manufacturers and styles.
Size charts, measurements, model information and recommendations are general guidance only.
SIEB does not guarantee a particular fit.
26. PRICING
Prices are displayed in U.S. dollars unless otherwise stated.
SIEB may prospectively change prices.
Obvious pricing, promotional or listing errors may be corrected where legally permitted.
If an affected order is canceled after payment, any legally required refund will be issued.
27. ORDERS AND ACCEPTANCE
Submitting an order does not necessarily constitute final acceptance.
SIEB may refuse, limit, investigate, hold or cancel orders where permitted by law because of Product unavailability, suspected fraud, unauthorized payment activity, identity-verification concerns, pricing errors, technical errors, shipping restrictions, promotion abuse, unauthorized resale or violations of these Terms.
28. PURCHASE LIMITS AND RESALE
SIEB may establish reasonable purchase limits.
Transactions reasonably believed to involve fraud, circumvention of purchasing limits or unauthorized commercial resale may be refused where permitted by law.
29. CUSTOMER INFORMATION
Customers are responsible for providing complete and accurate billing, contact and shipping information.
Customers should promptly report errors.
Changes cannot be guaranteed once fulfillment begins.
30. PAYMENT AUTHORIZATION
By providing payment information, customers represent that they are legally authorized to use the selected payment method and authorize charges for Products, taxes, shipping and other amounts clearly disclosed at checkout.
31. PAYMENT PROCESSORS
Payments may be processed by Shopify and independent payment providers.
To the fullest extent permitted by law, SIEB is not responsible for independent technical failures, authorization decisions or outages of payment providers outside SIEB's reasonable control.
32. FRAUD PREVENTION
SIEB may use reasonable fraud-prevention and transaction-verification procedures.
Transactions reasonably suspected of fraud, identity theft, stolen payment information, unauthorized payment activity, promotion abuse or unlawful conduct may be delayed, investigated, refused or canceled.
33. CHARGEBACKS
SIEB may contest fraudulent, abusive or knowingly false chargebacks using appropriate transaction records, communications, shipping information, tracking and delivery evidence.
Nothing restricts lawful rights concerning unauthorized or improper charges.
34. TAXES
Applicable sales, use and similar taxes will be collected when required by law.
SHIPPING AND DELIVERY
35. SHIPPING
Shipping and delivery dates are estimates unless expressly identified as guaranteed.
SIEB will comply with applicable requirements concerning promised shipment periods, delays, cancellation rights and refunds.
36. SHIPPING INFORMATION
Customers are responsible for providing complete and accurate shipping information.
To the fullest extent permitted by law, SIEB is not responsible for additional expense or delivery problems caused solely by customer-provided address errors.
37. SHIPPING DELAYS
Delivery may be affected by carrier delays, severe weather, holidays, natural disasters, transportation interruptions, customs, government actions, labor disruptions, supply-chain interruptions, emergencies and other circumstances outside SIEB's reasonable control.
To the fullest extent permitted by law, SIEB is not responsible for delays caused solely by circumstances outside its reasonable control.
38. LOST, STOLEN, DAMAGED OR MISDELIVERED PACKAGES
Customers should promptly contact SIEB concerning suspected lost, stolen, damaged, missing or misdelivered packages.
SIEB may investigate claims with carriers and request reasonable documentation.
Responsibility will be determined according to applicable law and the SIEB Shipping Policy.
39. MULTIPLE SHIPMENTS
Products within one order may originate from different production, warehouse or fulfillment locations and may therefore arrive separately.
40. SHIPPING CARRIERS AND FULFILLMENT PROVIDERS
SIEB may use independent carriers, logistics companies and fulfillment providers.
To the fullest extent permitted by law, SIEB is not responsible for independent acts or omissions of third parties outside SIEB's reasonable control.
RETURNS AND REFUNDS
41. RETURNS, REFUNDS AND EXCHANGES
Returns, refunds, exchanges and store credits are governed by the SIEB Return & Refund Policy applicable to the transaction.
Nothing eliminates remedies required by law for defective, damaged, materially misdescribed or legally nonconforming Products.
42. RETURN CONDITION
Where permitted by law and disclosed in the Return & Refund Policy, discretionary returns may be required to be unworn, unused, unwashed, unaltered, undamaged, free from odors, stains, makeup, deodorant and pet hair, and accompanied by applicable original tags and packaging.
43. FINAL SALE AND HYGIENE-SENSITIVE PRODUCTS
Products clearly marked FINAL SALE may be excluded from discretionary returns where permitted by law.
Certain Products may have additional hygiene-related restrictions where legally permitted and appropriately disclosed.
Mandatory remedies remain unaffected.
PRODUCT USE, CARE AND SAFETY
44. PRODUCT INSPECTION
Customers should reasonably inspect Products before use.
Do not use Products that appear materially broken, damaged or unsafe.
45. PRODUCT CARE
Customers are responsible for following Product labels, warnings, washing, cleaning and care instructions.
To the fullest extent permitted by law, SIEB is not responsible for damage caused solely by improper washing, drying, bleaching, ironing, cleaning, storage, heat exposure, chemical exposure, alteration or misuse.
46. APPAREL, SOCKS AND TEXTILES
Textile Products may experience normal fading, pilling, stretching, shrinking, wrinkling and wear depending upon materials, use and care.
Normal wear and tear does not automatically constitute a Product defect.
47. HAIR ACCESSORIES
Hair ties, scrunchies, headbands, clips and similar Products should be used for their intended purposes.
Certain Products may contain small parts or create choking, pinching or entanglement hazards if misused.
Keep potentially hazardous components away from babies and young children.
48. BAGS AND CARRYING ACCESSORIES
Bags, totes and pouches should not be overloaded or used for unintended purposes.
Unless expressly stated otherwise, SIEB does not represent that bags are waterproof, fireproof, impact-resistant, insulated, theft-resistant or designed to protect valuables, electronics or specialized equipment.
49. WATER BOTTLES AND DRINKWARE
Drinkware should be used according to its intended purpose and Product-specific instructions.
Do not use materially cracked, broken or unsafe drinkware.
Unless expressly identified otherwise, customers should not assume that drinkware is dishwasher safe, microwave safe, freezer safe, suitable for boiling liquids, suitable for hot beverages, suitable for carbonated beverages or completely leakproof.
Lids, caps and other components should be properly secured.
SIEB does not guarantee prevention of every spill or leak under every possible circumstance.
50. TOWELS, POOL AND BEACH PRODUCTS
Unless expressly stated otherwise, towels and similar Products are not flotation devices, life-saving equipment, personal protective equipment, medical devices or professional safety equipment.
51. MATERIAL SENSITIVITIES AND REACTIONS
Individuals may react differently to fabrics, dyes, elastics, plastics, finishes, adhesives, coatings or other materials.
Customers with known sensitivities should review available Product information.
Discontinue use if irritation or another adverse reaction develops and seek appropriate medical attention where necessary.
Nothing in this provision limits liability that applicable law prohibits SIEB from limiting.
52. CHILD SAFETY
Unless expressly marketed and labeled for children, SIEB Products should not be assumed to be children's Products.
Small parts, cords, straps, caps, clips or removable components may create choking, strangulation, entanglement or other hazards.
Appropriate adult supervision should be provided.
53. PRODUCT MISUSE
Products must be used safely, reasonably and for their intended purposes.
To the fullest extent permitted by law, SIEB is not responsible for loss, damage, injury or expense caused solely by:
• Product misuse;
• Use for an unintended purpose;
• Failure to follow warnings or instructions;
• Improper care, cleaning or storage;
• Unauthorized alteration or modification;
• Customer negligence; or
• Continued use after a user knows or reasonably should know a Product is materially damaged or unsafe.
54. PERSONAL INJURY AND PROPERTY DAMAGE
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SIEB SHALL NOT BE RESPONSIBLE FOR PERSONAL INJURY OR PROPERTY DAMAGE CAUSED SOLELY BY CUSTOMER MISUSE, FAILURE TO FOLLOW WARNINGS OR INSTRUCTIONS, UNAUTHORIZED MODIFICATION OR OTHER CONDUCT FOR WHICH SIEB IS NOT LEGALLY RESPONSIBLE.
Nothing in these Terms excludes or limits liability for defective Products, negligence, personal injury, wrongful death, Product liability or other matters to the extent applicable law prohibits exclusion or limitation.
55. NO MEDICAL OR SAFETY REPRESENTATIONS
Unless expressly stated otherwise, SIEB Products are fashion, apparel and lifestyle Products.
They are not medical devices, flotation devices, life-saving equipment, personal protective equipment or professional safety equipment and are not intended to diagnose, treat, cure, mitigate or prevent disease or injury.
56. ASSUMPTION OF ORDINARY RISKS
To the extent permitted by law, customers assume ordinary and obvious risks inherent in normal use of apparel, textiles, drinkware, bags, hair accessories and lifestyle Products that are not caused by Product defects or wrongful conduct attributable to SIEB.
WEBSITE, TECHNOLOGY AND THIRD PARTIES
57. THIRD-PARTY SERVICES
SIEB may rely upon independent providers for ecommerce technology, hosting, payment processing, manufacturing, fulfillment, shipping, communications, analytics and other services.
To the fullest extent permitted by law, SIEB is not responsible for independent acts, omissions, failures or outages of third parties outside SIEB's reasonable control.
58. THIRD-PARTY LINKS
The Services may contain links to independent websites or platforms.
SIEB does not control those services and does not guarantee their security, accuracy, availability, content or practices.
59. WEBSITE AVAILABILITY
SIEB does not guarantee uninterrupted or error-free website operation.
Maintenance, technical errors, server outages, software failures, inventory synchronization problems, internet interruptions and other disruptions may occur.
60. CYBERSECURITY
No internet-based service can guarantee absolute security.
Customers are responsible for reasonably protecting their devices, accounts, passwords and login credentials.
SIEB's obligations concerning personal information remain subject to applicable privacy and data-security law.
61. INTELLECTUAL PROPERTY
The SIEB name, branding, logos, trademarks, artwork, designs, photographs, videos, graphics, Product imagery, text and website content are owned by or licensed to SIEB LLC unless otherwise stated.
Purchasing a Product does not transfer intellectual-property ownership.
Unauthorized reproduction, distribution, modification or commercial exploitation is prohibited except where permitted by law.
62. USER CONTENT AND REVIEWS
Customers submitting reviews, photographs, videos, comments or other content represent that they have the legal right to submit such content and that it does not unlawfully infringe third-party rights.
63. PROHIBITED USE
The Services may not be used for fraud, identity theft, unauthorized access, malicious software, payment abuse, intellectual-property infringement, harassment, impersonation, website interference or other unlawful conduct.
EVENTS OUTSIDE SIEB'S CONTROL
64. FORCE MAJEURE
TO THE FULLEST EXTENT PERMITTED BY LAW, SIEB SHALL NOT BE RESPONSIBLE FOR DELAY OR FAILURE CAUSED BY EVENTS OUTSIDE ITS REASONABLE CONTROL, INCLUDING:
• Hurricanes;
• Tornadoes;
• Floods;
• Earthquakes;
• Fires;
• Severe or extreme weather;
• Natural disasters;
• Epidemics or pandemics;
• Public-health emergencies;
• War;
• Terrorism;
• Civil unrest;
• Government actions or restrictions;
• Trade restrictions;
• Customs or border delays;
• Transportation interruptions;
• Port congestion;
• Carrier failures;
• Labor disputes or strikes;
• Supply shortages;
• Supply-chain interruptions;
• Utility failures;
• Internet outages;
• Technology failures; or
• Other events outside SIEB's reasonable control.
This provision does not eliminate statutory cancellation, refund or other mandatory rights.
WARRANTIES, LIABILITY AND LEGAL PROTECTION
65. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIEB DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, CONDITIONS AND GUARANTEES NOT EXPRESSLY PROVIDED BY SIEB OR REQUIRED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Where applicable law does not permit a particular disclaimer, that disclaimer applies only to the maximum extent permitted.
66. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIEB LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS AND REPRESENTATIVES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE WEBSITE, SERVICES, PRODUCTS, ORDERS, PAYMENTS, SHIPPING, DELIVERY, RETURNS OR PRODUCT USE WHERE SUCH DAMAGES MAY LAWFULLY BE EXCLUDED.
Nothing in these Terms excludes or limits liability, warranties, duties or remedies that applicable law prohibits SIEB from excluding or limiting.
67. INDEMNIFICATION
To the fullest extent permitted by law, users agree to indemnify and hold harmless SIEB LLC and its owners, officers, employees, agents and representatives from third-party claims, liabilities, damages and reasonable expenses arising from the user's fraud, unlawful conduct, unlawful Product misuse, violation of these Terms or infringement of third-party rights.
Customers are not required to indemnify SIEB for SIEB's own negligence, defective Products, unlawful conduct or liability that applicable law prohibits SIEB from transferring.
68. MAXIMUM LAWFUL PROTECTION
The disclaimers, exclusions, limitations and allocations of responsibility contained in these Terms are intended to provide SIEB LLC with the maximum protection permitted by applicable law.
If any exclusion or limitation cannot legally be enforced in full, it shall be enforced to the maximum extent legally permissible.
GENERAL LEGAL PROVISIONS
69. UNITED STATES AND STATE-SPECIFIC RIGHTS
Federal and state laws concerning consumer protection, warranties, advertising, shipping, returns, refunds, privacy, safety and Product liability may vary.
Where mandatory applicable law provides a non-waivable right or remedy, that protection controls to the extent required.
Nothing in these Terms voluntarily expands SIEB's obligations beyond applicable law.
70. GOVERNING LAW
To the extent legally permissible, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Mandatory federal or state protections that cannot lawfully be waived remain applicable.
71. DISPUTE RESOLUTION
Before initiating formal legal proceedings, SIEB and customers are encouraged to make reasonable good-faith efforts to resolve disputes directly.
Nothing in these Terms restricts a legal right or remedy that applicable law prohibits SIEB from restricting.
These Terms do not create mandatory arbitration or a class-action waiver unless SIEB separately adopts legally enforceable provisions establishing such requirements.
72. PRIVACY
Collection and processing of personal information are governed by the SIEB Privacy Policy and applicable law.
73. EMAIL AND SMS COMMUNICATIONS
SIEB may send transactional communications concerning orders, payments, shipping, delivery, returns, security and customer service.
Marketing emails and SMS communications are subject to applicable consent and opt-out requirements.
A purchase alone does not constitute consent to every form of marketing communication.
74. CHANGES TO THESE TERMS
SIEB may update these Terms prospectively.
Updated Terms will display a revised Effective Date or Last Updated date.
Notice or consent will be provided where required by law.
75. SEVERABILITY
If a provision is invalid, unlawful or unenforceable, it shall be enforced to the maximum extent legally permissible or severed where appropriate.
The remaining provisions remain effective.
76. NO WAIVER
SIEB's failure to enforce a provision on one occasion does not permanently waive the right to enforce that provision later.
77. LEGAL NOTICE INCORPORATED BY REFERENCE
The SIEB Legal Notice & Liability Disclaimer is incorporated into these Terms by reference.
The disclaimers, limitations, customer responsibilities and other protections contained in the Legal Notice apply to the maximum extent permitted by applicable law.

These Terms should be read together with the:

• SIEB Shipping Policy;
• SIEB Return & Refund Policy;
• SIEB Privacy Policy; and
• Applicable Product-specific warnings and instructions.
79. CONFLICT WITH MANDATORY LAW
If these Terms or another SIEB policy conflicts with mandatory applicable law, mandatory law controls only to the extent required.
All remaining provisions continue to apply to the maximum extent permitted by law.
80. ENTIRE AGREEMENT
These Terms, together with policies and Product-specific terms expressly incorporated by reference, constitute the applicable agreement concerning use of SIEB Services and purchases from SIEB.

ALL DISCLAIMERS, LIMITATIONS OF LIABILITY, CUSTOMER RESPONSIBILITIES, ASSUMPTIONS OF ORDINARY RISK AND ALLOCATIONS OF RESPONSIBILITY CONTAINED IN THESE TERMS AND THE SIEB LEGAL NOTICE APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
NOTHING IN THESE TERMS SHALL BE INTERPRETED AS EXCLUDING OR LIMITING ANY LIABILITY, WARRANTY, DUTY OR CONSUMER REMEDY THAT APPLICABLE LAW PROHIBITS SIEB LLC FROM EXCLUDING OR LIMITING.
IF ANY DISCLAIMER, EXCLUSION OR LIMITATION CANNOT LEGALLY BE ENFORCED IN FULL, IT SHALL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW WITHOUT INVALIDATING THE REMAINDER OF THESE TERMS.
